城市管理中行政执法的困境与对策——以邵阳市为例

摘要
随着改革的不断深入,在加快推进城市化发展的新形势下,城市管理工作尽管
日益得到重视并且有所改善,但依然存在许多不容忽视、亟待解决的问题。而且城
市管理已经成为当前城市化过程中出现的诸多矛盾的聚焦点,因此,要实现城市化、
构建和谐社会,就必须加强城市管理体制的改革与创新,积极创新城市管理方式,
完善城市管理体系和政策法规,优化城市管理执法环境。而城市管理相对集中行政
处罚权就是将城市管理领域内由多个有关行政机关行使的若干行政处罚权相对集中
起来,交由一个行政执法主体来行使,旨在解决城市管理领域存在的多头执法、职
责交叉、重复处罚、执法扰民、行政机构膨胀、行政效率低下等问题。但是在实际
工作中,城市管理行政执法依然存在着执法依据不充分、体制不规范、范围过于宽、
人员素质差等问题。其主要原因是对城市管理行政执法及城市管理行政执法机构性
质、功能、定位认识模糊。本文以湖南省邵阳市城市管理行政执法作为研究对象,
通过对邵阳市在城市管理行政执法方面的具体行为进行分析,对该市城市管理行政
执法中存在的问题和原因进行实证分析,反映出目前我国城市管理行政执法存在的
普遍问题,并提出解决问题的对策,其中将主要从人员素质、保障制度、执法方式
等方面进行探讨,以求为城市管理行政执法提供比较系统的思想和措施。

Abstract
Along with reform unceasingly deepening and under the new situation of advancing
urbanization development, although City management work is emphasized day by day and
improved, it still has the problem which is not allow to neglect, urgently awaits to be
solved. Moreover the city management has already been the focus points of many
contradiction which is appeared in the current urbanized process, Therefore, In order to
realize the urbanization, the construction of harmonious society, we must strengthen the
reform and the innovation of the city management system, innovate the city management
way positively, perfect the city management system and policy laws and regulations,
optimize the environment of city management. however the city management relative
central administrative sanctions power is concentrating all kinds of sanctions power into a
main body of administrative law enforcement for the purpose of solving problem in the
area of city management. But in the practical work, the city management administration
law enforcement still has many problem. The primary reason is lacking of clear
understanding in the nature, the function, the localization of the city administrative
