摘要

我国是一个体育大国,在世界体坛占据重要位置,但是我国的职业体育纠纷解决
机制却相对滞后。本文旨在通过分析我国现行职业体育纠纷解决机制存在的漏洞,参
照国际通行的纠纷解决方式,提出构建我国职业体育纠纷解决机制的一些设想,以使
我国职业体育能够良好得发展、同时适应职业体育国际化、全球化得发展。
第一部分,职业体育纠纷概述。首先对与职业体育相关概念的进行比较,进而明
确本文研究的核心概念之一即职业体育,其次分析职业体育纠纷的特征,职业体育纠
纷的分类,职业体育纠纷产生的原因,职业体育纠纷解决的意义。
第二部分,职业体育纠纷解决机制的基本途径。体育谈判或和解,体育组织内部
纠纷解决方式,体育纠纷的外部仲裁与调解解决方式,体育纠纷的诉讼解决机制。
第三部分,职业体育纠纷解决机制的域外经验。本部分主要通过介绍国外职业体
育发达国家纠纷解决机制方面的先进经验和一般做法,以及对我国有益的可以借鉴的
方式和具体做法。
第四部分,我国职业体育纠纷解决机制的现状以及存在的主要问题。本部分主要
通过案例分析的方法介绍我国职业体育领域中的典型案例,揭示出我国职业体育纠纷
解决机制的不足,找出差距,以便更好得解决面临的难题。
第五部分,完善我国体育纠纷解决机制的对策建议。从体育管理体制方面和相关
立法和制度设计入手,完善我国职业体育纠纷解决机制。

Abstract

China is a sporting nation that occupies an important position in the world. But our
professional sports dispute resolution mechanism is relatively weak. This paper analyzes
the loopholes which exist in our dispute settlement mechanism of Professional Sports.
Referencing to the prevailing international dispute resolution, the author gives some ideas
about constructing our professional sports dispute resolution mechanism. With these ideas,
the author hopes our professional sports can have a good development, and can meet the
progress of the professional sports’ internationalization and globalization.
The first part: The summary of professional sports. Firstly, the pares the
relevant concepts of professional sports. And then, clarifies one of the core concepts of this
research, that is, professional sports. Secondly, the author analysis the characteristics of
