笔者近年在侦办电信诈骗案件的过程中,切身体会电信诈骗作为一种新型的
侵犯财产类犯罪,其社会危害性已到了各级相关部门必须重视的地步。本文阐述
了电信诈骗犯罪的概念、起源和发展过程及目前我国电信诈骗犯罪的现状,并分
析了电信诈骗区别与普通诈骗的五个特点。目前在我国较为常见,且犯罪份子诈
骗成功率较高的电信诈骗手段约有十多种,本文中对这些诈骗手段进行归类和揭
露。目前执法机关在打击电信诈骗犯罪中,在案件侦破、抓捕主犯、追回赃款、
获取证据等方面存在诸多困难,本文分析了造成这些困难的现实原因,要从根本
上解决这些困难,应当进一步完善相关立法,如对电信诈骗犯罪单独立法,从立
法上加强对个人信息的保护等。公安机关作为打击和防范电信诈骗犯罪的一线部
门,应积累相应的侦查对策和防范措施,本文提出案发后要尽快做好取证工作,
追查被骗资金的流向,利用虚拟身份好友拓展团伙成员,建立经营案件意识等侦
查对策,以及建立反诈骗专线和打击电信诈骗的专业队伍,推进多方协作以创建
高效打击机制,做好电信诈骗的社会面防范工作等防范措施。由于电信诈骗犯罪
离不开电话、互联网和银行卡、网上银行等现代化通讯、金融工具,因此相关部
门应当承担起社会义务,堵上各自业务中的漏洞,本文对电信业、银行业中存在
的主要问题也提出了改进建议。

Research on the Tackling of Fraud Crime
Abstract
In rencet years the writer handle some cases of fraud crime, experience
that fraud crime jeopardize the safety of the society which related Government
departments should attaches great importance to. The article introduce the conception,
origin,development of fraud crime and the current situation in china,analyse
the differences mon fraud crime and fraud crime. Currently there
are about fifteen tricks which have high ess rates,the article exposed the fact of
these tricks. There are some difficulties when law enforcement officials cracking down
on fraud crime,the article analyze the reasons of these difficulties,to resolve
these difficulties radically,we should improve the related Law in china,for example,
make laws on fraud crime and Personal Information protection. Public security
organ shoulder the burden of crack down on fraud and take strict precautions
against it, the article point out that policemen should investigate and collect evidence
quickly, trace the illicit money,find out plices through qq or msn and so on.
