我国高等教育行政规划行为法治化问题探析

摘要
政府在高等教育领域的行政规划对于高等教育的发展而言,具有指明方向,
明确目标,选择路径等重大作用。在我国,面对稀缺的高等教育资源,面对日益
激烈的人才竞争,如何更有效地进行人才培养,如何让人尽其才,学有所用,需
要政府及其主管部门依法制定出我国高等教育科学、合理发展的规划。
在高等教育领域中,存在大量的行政规划行为,但规划的法治化程度不高,
制定主体复杂,无行政规划组织法上的相关规定,内容的具体实施效果不佳,规
划的程序、救济方面法律规制的缺失。作为一种行政行为,在高等教育这一特殊
领域迫切要求其走上法治化轨道,通过法治理念、法治程序,做出科学的行政规
划行为。在依法行政、构建法治社会的大背景中,提高高等教育行政规划的法治
化程度是解决众多问题的可行路径。
本文试图以法治化的角度,对高等教育领域行政规划行为进行法理剖析,从
依法行政、政府职能转变的法治环境出发,通过分析我国高等教育领域行政规划
行为理论和实践中存在的问题,提出我国高等教育行政规划法治化是其必然趋
势。在借鉴域外规划理念、模式和相关法律程序的同时,结合我国自身情况,提
出我国高等教育行政规划法治化完善的若干途径。笔者认为法治思想、理念有待
进一步形成,法治原则的运用在高等教育行政规划领域表现为:协调原则、从实
际出发的合理原则、公开原则、信赖利益保护原则等。法治原则的树立是高等教
育行政规划走上法治轨道的前提,而严格、复杂的法律程序是高等教育行政规划
内容科学、合理的重要保证。司法救济的完善是高等教育行政规划法治化的重要
体现,对规划主体权力的制约、监督提供一种方式,为相关利害主体权利的保护
明确一种路径。

Abstract
The government’s administrative planning plays an important role in the
development of higher education. It can help show the direction, clarify goals, and
choose the path for future development. In China, because of the scarce higher
education resources and the increasing petition for talent, the government
and relative departments should make a scientific and reasonable plan for the
development of higher education on how to make full use of one’s talent and what
they have learnt and how to cultivate talents efficiently.
In the area of higher education, there are a lot of administrative planning
behaviors, but there also exist a lot of problems. The enforcement of administrative
planning is limited. The planning-makers plex. There are no relative rules for
the planning. The enforcement of the content is ineffective and there is lack of
legal provisions about planning procedures and judicial relief.
In this special field of higher education, administrative planning, as an
administrative act, needs to be guided onto the track of ruling-by-law. The
government should make a scient
