交通事故损害赔偿社会化救济制度研究

摘要
交通事故所引发的灾害已经成为诸多社会问题之一,交通事故受害人如何及时获得赔偿就
非常重要。本文从损害赔偿的社会化角度切入研究责任保险和社会救助基金制度。我国目前实
行的《道路交通安全法》和《机动车责任强制保险条例》建立的强制责任保险制度和社会救助
基金制度,保障了交通事故中受害人的基本权益,反映出我国在交通事故损害赔偿领域的社会
化趋势,但这些制度起步晚,还有很多不完善之处。
本文共分为三章,第一章首先从理论的高度介绍了在交通事故领域实行损害赔偿社会化的
研究,接下来在论文的第二章交通事故损害赔偿社会化概述中阐述了交通事故损害赔偿社会化
的内涵,引入损害赔偿社会化的必要性及其交通事故损害赔偿社会化实现的两种路径,实现交
通事故损害赔偿社会化的两种路径是机动车责任保险和社会救助基金。最后论文的第三章针对
交通事故损害赔偿社会化领域中存在的问题及其完善提出了相关建议,本章论述主要介绍了我
国交通事故损害赔偿制度的发展演变,对我国交通事故损害赔偿社会化领域存在的问题可以通
过借鉴美国、日本等国交通事故损害赔偿理论和实践加以完善。
交通事故损害赔偿领域存在着侵权救济、责任保险和社会救助三种途径。我们应当充分发
挥不同的救济机制的优点,建立符合我国国情的交通事故受害人救助机制。

Abstract
Disasters caused by traffic accidents have e one of many social problems, how to timely
access pensation for victims of traffic accidents is very important. In this paper, the social
