先秦法家学派的文学创作与文学风格

摘要

作为先秦诸子中最具政治色彩的一家,法家学派的文章是为制法治世而作。经历了春秋时期
的启蒙和战国时代的发展,先秦法家在熔铸诸子学说的基础上发展了自己的思想,在执政改革的
实践中形成了自己的学术派别。伴随着法家思想的成熟和制法观念的成型,先秦法家的文学作品
也由一开始宣传法律的条文,到阐述法律思想,由诸子之政论发展为文学,其文本逐渐成熟,风
格也得以凸显。
管仲之《管子》是先秦法家学派最早的集束之作;战国中期的商鞅在“百家争鸣”中独树一
帜,成为先秦法家在政治实践、律法理论上的最高代表,在这基础之上,战国末年的《韩非子》
“观往者得失之变”,奠定了完整的法家思想系统。其文章峭拔锋锐、质朴无华,充分体现出
法家文学特有的气质和风格,成为集前代法家思想与文学的大成之作。从管子时期的成文法,
到商鞅的为法而作文,再到韩非的以文释法,伴随着法家思想的成熟,也标志着法家文学发展的
三个阶段。法家的文学创作由此显示出了异于其他诸子的文学特色,法家的文学风格,也就成为
了先秦文学中专属“法家文学”的独特标记,在诸子百家中卓尔不群,脱颖锋芒。
本文尝试从先秦法家学派的产生、流变与思想入手,追溯法家文学的发展历程,法家的文学
思想在《管子》、《商君书》和《韩非子》中的发展与表现,并籍此探析法家文学独有的价值观与
文学风格,以及法家文学对后世文学的影响。

Abstract

Warring States Period, The Legalism eveloped its own’s deology, basis on the other schools. The
formation of school Practice in the reform. With the maturity of the thought and Specific maturity legal.
the Legalism literatures development of literature from Ordinances, Thought,and Political theory,the
text Gradually mature,and the Style has e prominent.
The Gan’s written by Guan zhong is the earliest work in per-Qin, In the medium of
Warring States times,shang yang is Outstanding in all into the best Representative
with Politics and Theory’s.
Based on those Practices, Han fei referenced History and distinguished experiences, pletely
system. he's Literature rigorous and pointed very well,he’s frank ,honest,so he’s article reflect the
temperament of lawyers.
