文档介绍：中国法官助理制度研究中文提要中国法官助理制度研究中文提要法官助理制度是国外发展起来的一项重要的法官辅助人员制度,它对于提高法官的审判效率、保障司法公正起着非常重要的作用。世界上许多国家的司法机关已经设置了法官助理一职,以提高其法官职业化水平。当前,中国正在进行全面的司法改革,最高人民法院于2002年7月明确提出了要加快法官队伍的职业化建设,建立一支高素质的职业法官队伍的改革方案。其中,最引人注目的人事制度改革措施之一就是为法官配备法官助理,试行法官助理制度。本文以法官职业化为改革定位, 结合我国国情,从当前中国法官所承担的职责及存在的问题出发,阐述设立法官助理的必要性,并对法官助理的法律定位、职责、管理及配备等问题进行了探讨,提出了完善我国法官助理制度的具体设想j为我国法院系统的法官职业化建设提供了有益的参考。【关键词】司法改革法官职业化法官助理制度作者:胡伟指导教师:王克稳中国法官助理制度研究英文提要 AStudy on Judges’Assistant System inChina Abstract Judges’assistant system is all important mechanism ofauxiliary staff developing inforeign plays avitalrolein theimprovement of judicial efficiency andtheguaranty ofjudicial topromote the levelofjudicialprofessionalization,judges’assistant system hasbeen setin many ,all overalljudicial reform isgoing People’SSupreme Court made theclearprojects tospeed up the construction ofjudicial professionalizationand tosetan advanced professionalstaffin/uly, most outstandingreforming measure on personnel system isto provide assistantsforjudges and to setjudges’assistant system on trial.
