醉酒驾驶机动车引发的交通事故，已经成为社会的一大公害。为了减少醉酒驾驶机动车的行为，刑法修正案八增加了危险驾驶罪，对包括醉酒驾驶机动车在内的危险驾驶行为追究刑事责任。本文认为醉酒驾驶行为既使未发生实害的，对公共安全也构成了极大的威胁，属于行为犯，这一行为一经实施便构成犯罪，应按刑法第133条第2款的规定追究刑事责任。醉酒驾驶机动车的行为除了对公共安全产生威胁，更会导致实害的发生，造成严重人身损害和财产损失。对产生实害的醉酒驾驶行为，应根据行为人主观罪过的大小，追究其刑事责任，不应客观归罪。
