2、擅自进入国家规划矿区、对国民经济具有重要价值的矿区和他人矿区范围采矿；
3、擅自开采国家规定实行保护性开采的特定矿种。
（二）下列情形可以认定为破坏性采矿：
采矿权人违反审查批准的矿产资源开发利用方案开采矿产资源，并造成矿产资源严重破坏的行为，包括：开采顺序或开采方法不合理，开采回采率或采矿贫化率达不到设计要求，选矿工艺不合理或选矿回收率达不到设计要求，对暂时不能综合开采的矿产、采出而暂时还不能综合利用的矿产或含有有用组分的尾矿，应当但没有采取有效保护措施防止损失破坏等。
