第三章合同签定
第五条各街、镇应与聘用的社会救助工作人员签订劳动合同，根据区人力资源和社会保障局提供的合同范本，结合各街、镇社会救助工作的实际和管理工作需要，制定聘用劳动合同书，与拟聘人员签定聘用合同，并报区民政局备案。

第六条聘用合同应当包括的主要内容有:街、镇或社区名称，法定代表人或者主要负责人；聘用人员的、住址和居民身份证或者其他有效身份证件号码；聘用合同期限；工作内容和工作地点；工作时间和休息休假；工作报酬；社会保险；劳动保护、劳动条件和职业危害防护；法律、法规规定应当纳入劳动合同的其他事项。
第七条聘用合同的期限由各街、镇根据聘用人员的具体情况确定，最长不超过3年，对新聘用人员实行试用期制度，试用期依合同期限决定。合同期限3个月以上不满1年的，试用期不得超过1个月；1年以上不满3年的，试用期不得超过2个月；3年以上的，试用期不得超过6个月，试用期包括在聘用期限内。试用期内达不到使用要求的，可解除合同。合同解除后，应报区民政局备案。
第八条聘用合同期满或双方约定的合同终止条件出现，合同即行终止；聘用合同期满，且考核合格的，双方愿意续聘的，可续签聘用合同；终止、续签合同需同时报区民政局、区财政局备案。聘用合同经双方协商同意，并区民政局、区财政局备案备案后，可变更或解除。
第九条聘用人员提前30日以书面形式通知用人单位，可以解除聘用合同。聘用人员在试用期内提前3日通知用人单位，可以解除聘用合同。
