(十一)其他需要储备的土地。 
    非工业区的现有工业用地及工业厂房用地，无论是出让地还是划拨地，不改变用途转让或补办出让手续的，以及所出让用地闲置两年以上的，在进入土地交易市场前，一律先由市土地储备机构进行可行性研究，认为值得盘整收回或收购的，经报市政府讨论同意后，依法有偿收回，进入市土地储备中心储备。 
第六条市区规划区内未征(转)用的农用地，列入土地储备规划，进行规划控制。 
    市区规划区内的农用地需要储备的，市土地储备中心必须依法办理征用手续。 
第七条土地储备须符合土地利用总体规划、城市规划实施的需要，符合城市经济社会发展的需要，依法保护土地权利人的合法权益。

第八条储备的土地应优先用于符合城市规划的建设项目。进行房地产开发、商业、旅游、娱乐等经营性项目建设使用储备土地的，须通过有形土地市场公开交易。 
第九条纳入储备范围的国有土地，由市土地储备中心统一收回、收购储备，原土地使用权人不得自行处置和拒绝收回、收购。 
    土地使用权被依法收回或收购的单位或个人，必须按期、按规定交付土地。 
第十条市土地储备中心应根据土地利用总体规划、城市规划和土地市场供求状况，拟定土地储备计划。土地储备计划经市国土资源局报市政府审批后，由市土地储备中心具体组织实施。
    经批准列入土地储备计划范围内的土地，应向社会公告。 
第十一条市土地储备中心应依照法律、法规和规章的规定，通过招标，选择有相应资质的施工单位对储备的土地进行前期开发。 
第十二条土地收购储备应依法办理土地权属变更登记手续。 
第十三条市计划、经贸、建设、规划、财政、房产等管理部门应按各自职责，协助做好土地储备的相关工作。
第二章土地储备
第十四条土地储备可采用下列方式: 
(一)征用。根据土地管理法律、法规的规定将集体土地征收转为国有建设用地。
