第二章 规划管理
第八条 在县级以上地方人民政府城市规划行政主管部门指导下，XX镇规划由XX镇人民政府负责组织编制。
编制XX镇规划应当依照?村XX镇规划标准?进行。
第九条 XX镇的总体规划报县级人民政府审批，详细规划报XX镇人民政府审批。XX镇人民政府在向县级人民政府报请审批XX镇总体规划前，须经XX镇人民代表大会审查同意。
第十条 任何组织和个人不得擅自改变已经批准的XX镇规划。确需修改时，由XX镇人民政府根据当地经济和社会开展需要进行调整，并报原审批机关审批。
第十一条 XX镇规划区内的土地利用和各项建设必须符合XX镇规划，服从规划管理。
任何单位和个人必须服从XX镇人民政府根据XX镇规划作出的调整用地决定。
第十二条 XX镇规划区内的建设工程工程在报请方案部门批准时，必须附有县级以上建设行政主管部门的选址意见书。

第十三条 在XX镇规划区内进行建设需要申请用地的，必须持建设工程的批准文件，向XX镇建设行政主管部门申请定点，由XX镇建设行政主管部门根据规划核定其用地位置和界限，并提出规划设计条件的意见，报县级人民政府建设行政主管部门审批。县级人民政府建设行政主管部门审核批准的，发给建设用地规划许可证。建设单位和个人在取得建设用地规划许可证后，方可依法申请办理用地批准手续。
第十四条 建设规划用地批准后，任何单位和个人不得随意改变土地使用性质和范围。如需改变土地使用性质和范围，必须重新履行规划审批手续。
第十五条 在XX镇规划区内新建、扩建和改建建筑物、构筑物、道路、管线和其它工程设施，必须持有关批准文件向XX镇建设行政主管部门提出建设工程规划许可证的申请，由XX镇建设行政主管部门对工程工程施工图进行审查，并提出是否发给建设工程规划许可证的意见，报县级人民政府建设行政主管部门审批。县级人民政府建设行政主管部门审核批准的，发给建设工程规划许可证。建设单位和个人在取得建设工程规划许可证件和其他有关批准文件后，方可申请办理开工手续。
第十六条 在XX镇规划区内建临时建筑，必须经XX镇建设行政主管部门批准。临时建筑必须在批准的使用期限内撤除。如国家或集体需要用地，必须在规定期限内撤除。
