        一、协议离婚制度的含义和意义
        我国的离婚制度，分为协议离婚和诉讼离婚两种。由于婚姻关系当事人对离婚所持的态度不同，在处理程序上也不大相同。
        协议离婚也叫“双方自愿离婚〞，是指婚姻关系当事人达成离婚合意并通过婚姻登记程序解除婚姻关系的法律制度。其主要特征，一是当事人双方在离婚以及子女和财产问题上意愿一致，达成协议；二是按照婚姻登记程序办理离婚登记，取得离婚证，即解除婚姻关系。
        协议离婚制度，是我国离婚制度的重要组成局部。这项制度在５０年的实践中，由于它充分尊重当事人的意愿，且程序简便，因此为婚姻关系当事人充分接受。与此同时，婚姻登记机关也积累了丰富的经验，在制度上日趋完善。随着我国婚姻家庭法制的不断健全，当事人采用协议方式，通过非讼程序解决离婚问题，已被越来越多的当事人作为首先考虑的途径。
        从法律上确立协议离婚制度有以下重要意义：
