文档介绍：【内容提要】本文比较了德国《民法典》法律行为与德国《商法典》商行为规定的基本内容,梳理了德国关于法律行为与商行为的学说观点,试图找出法律行为与商行为之间背后的逻辑关系。同时,本文梳理了我国关于民事法律行为、民事行为、商行为的学说观点,对其进行分析,厘清三者之间的关系。笔者建议,对于我国法律行为、商行为的立法,可依据德国处理法律行为和商行为之间背后的逻辑关系,借鉴德国《民法典》和《商法典》对法律行为与商行为相互关系的立法技术,完善我国法律行为与商行为的相关立法。
