    第二章  建设和养护
    第九条  高速公路建设应当遵循根本建设程序，严格执行国家规定的工程设计、施工和监理标准及技术标准，保证合理设计施工周期，确保工程质量。
    高速公路建设工程应当按照国家有关规定实行招投标制度、工程法人及资本金制度、合同管理制度、工程监理制度和工程质量责任追究制度。
    第十条  高速公路建设需要移动或者拆迁桥梁、渡槽、管道、杆线、电力和通讯设施等以及对其他道路设施造成损害的，高速公路建设单位应当按照不低于该设施原有的技术标准予以修复，或者给予相应的经济补偿。
    第十一条  国内外经济组织依法投资建设高速公路的应当实行特许经营。投资经营者的合法权益受法律保护。
    特许经营工程应当采取招投标方式选定投资经营者。
    省人民政府授权省交通主管部门或者市州人民政府与依法成立的高速公路企业工程法人，签订特许经营协议。特许经营协议标准文本由省交通主管部门制定。
