关于处理婚姻案件中子女抚养、
财产分割及住房安置问题的几点意见
近几年来，随着经济建设的发展和人民生活水平的提高，婚姻案件的特点发生了显著的变化。子女抚养家庭财产的分割及离婚后的住房安置等问题，往往是当事人激烈争执的焦点。为了正确的解决这些问题，进一步提高婚姻案件的质量，根据《婚姻法》和最高人民法院《关于贯彻执行民事政策若干问题的意见》及其他有关法律、政策的规定，提出以下处理意见，供我市各级人民法院在审判婚姻案件时参考。

一、关于离婚后的子女抚养问题
１．人民法院对于准备调解或判决离婚的案件，在确定未成年子女归谁抚养时，应坚持有利于子女身心健康成长的原则，同时应根据父母双方所具备的抚养条件，父母的思想品德等因素综合考虑。
对于子女有识别能力的（指能自主、清楚地表示本人意见），一般应征询子女的意见，并应尊重子女的意见。
２．双方离婚后，在哺乳期内的子女，原则上应归母亲抚养。根据我市情况，哺乳期可掌握为一年。
３．对于哺乳期内的子女，如母亲不愿抚养，或不具备抚养条件，而父亲一方愿意抚养，又具备抚养条件的，可以调解或判决子女归父亲抚养。
４．子女抚养费的数额，应根据子女的实际生活、学****需要，父母的收入情况和当地群众的一般生活水平综合考
