公务员的任免(appointment and dismissal)是公务员任用与免职的统称
公务员的任用(appointment)是指依法享有任免权的机关或个人根据有关的法律规定和任职条件,通过法定程序和手续,任用公务员担任某一职务
公务员的免职(dismissal)是指依法享有任免权的机关或个人根据有关的法律规定,通过法定程序和手续,免除公务员所担任的一定的职务

公务员的任职资格(Qualifications)包括所有公务员都必须具备的一般要求和担任不同职系、职级的职务所必需具备的特殊要求,有的是从积极的资格要求作出规定,有的是从消极的资格要求作出限制。

我国《公务员法》规定,公务员任职必须在规定的编制限额和职数内进行,并有相应的职位空缺

公务员任免制度 Civil service appointment and dismissal System
根据有关法律精神,我国公务员具有下列情形之一,应予任命:
(1)新录用公务员试用期(Probationary period)满合格的; (2)从其他机关及企业、事业单位调入国
家行政机关的;
(3)转换职位任职的;
(4)晋升或降低职务的;
(5)免职后恢复工作的;
(6)其他原因需要任职的。

根据有关法律精神,我国公务员具有下列情形之一,应免去现任职务:
(1)转换(transformation)职位的;
(2)晋升(up)或降低(dowm)职务的;
(3)离职(separation from service)学****期限超过一年的;
(4)因健康(health)原因不能坚持正常工作一年以上的;
(5)调出(transfer out)国家行政机关的;
(6)退休(retirement)的;
(7)因其他原因需要免职的。

公务员兼职(Part-time job)的限制性规定主要包括:
禁止公务员擅自兼任营利性(Profit)的公职和私职;
在非营利性(Non-profit)部门兼职,须经有关部门批准,且有一定限制;
禁止任何公务员在其行政部门或公共事业部门所管辖的或者说与之有关的企业中谋求私利;
如果其配偶等直系亲属以职业身份从事营利性的私人活动,该公务员必须向他所属部门提出声明

我国《公务员法》也对公务员任职作了限制性的规定,该法第四十二条规定,公务员因工作需要在机关外兼职,应当经有关机关批准,并不得领取兼职报酬
