论无权处分合同的效力

摘要: 世界各国关于无权处分合同效力的规定因采用的物权变动模式不同而有所不同。我国合同
法第 51 条等条款对无权处分合同的效力的规定不妥当且充满矛盾和歧义, 有待改进。事实和相关
法律制度表明, 承认无权处分合同有效有利于对无权处分相对人的保护, 而无害于处分权人的利
益, 并能因此使无权处分引起的纠纷得到很好地解决。合同当事人处分权的欠缺不应当影响合同
的效力。承认无权处分合同有效这是国际趋势。我国未来的民法典中应承认除法律有特别规定
外, 无权处分他人财产的合同有效。

Effect of the Contract of the Ex Right Disposition

Abstract: The effect o f the contr act of the ex right disposition is different under the differ ent real
- right- alternation- patterns. Article 51 and som e other articles o f the Contract Law o f China
for the effect of the contr act o f the ex rig ht dispo sition are not suitable and full of conflicts and
am big uities and thus need improving. Facts and the relative institutio n o f law indicate that admit-
ting the effect of the co ntract of ex rig ht dispo sition can protect the relativ e parties o f the contract
, do no harm to the benefit o f the people w ho ow n the right of disposal and deal w ith the dispute
