和谐社会视域中我国土地征收制度改革研究

摘要
土地征收是指国家为了公共利益的需要,依照法律的规定,对本具有不可侵犯
的个人、集体土地所有权以强制取得并给予补偿的制度。我国现有的土地征收制度
脱胎于计划经济时代,是以“建设”需要为标准的征收模式,已不能适应时代发展
的要求,违背了科学发展观的精神,更与和谐社会不相符合。
本文以和谐社会理论为主要研究框架,结合农民权利贫困论、责任政府论,综
合分析我国现行土地征收制度中存在的问题:立法理念的内在缺失、土地征收“公
共利益”目的泛化、农民土地权利的虚置、政府征地责任义务缺位。
本文结合和谐社会的基本内涵,从“公平正义、民主法治、安定有序、人与自然
和谐相处”四个方面阐释和谐社会理念对征地制度改革的要求;根据征地制度存在的
问题及和谐社会理念对其的要求,重新设计制度理念、改革土地征收立法、切实保
障农民土地权利、加大政府征地责任义务。

Abstract
Land expropriation is a system that the state can deprive land property rights of any
personal and collective pensate them properly by law for the state’s public
benefits. The present land expropriation system originated from planed economic times
and it’s the model taking the construction as criterion, so it can’t satisfy the needs for the
age, violate the spirits of scientific development ideas and can’t conform the harmonious
society.
Based on the theory of Harmonious Society as the main framework for research, the
bines the theory of right poverty, the theory of responsible government to
comprehensively analyze the problems in current system of land expropriation of our
country: the inherent deficiency of concepts of legalization, illegibility and nonstandard
of institutional legislation, the vanity of farmer’s land right, the lack of obligation of
government to expropriate.
Combining the basic connotation of Harmonious Society, the text elucidates the
request of concepts of Harmonious Society to innovation of land expropriation system
from four aspects—“equity and justice, democracy and legality, stability and order, stable
and orderly”; according to problems in the system of land expropriation and the request
from Harmonious Society, the text advises to policy from concept of designation to system,
legislation to land expropriation, guarantying to farmer’
