摘要
补贴问题包含两方面一是补贴二是反补贴而反补贴法则对这两方面都加以规制。
《协定》并不是简单地规范政府的补贴行为单纯地采取反补贴措施而是对补贴与反补
贴同时加以规制并对反补贴措施及其程序都加以严格的规定。可见反补贴法特别是衡补贴与反补贴的关系起着不可替代的作用。
随着我国外贸出口的增长和贸易大国地位的确立,我国出口产品面临着越来越多的贸易
救济措施的调查。种种迹象表明,今后国外对我国反补贴调查的数量可能将逐渐增多。所以
无论是政府还是企业都要做好积极应对国外反补贴诉讼的准备。
本文采用了历史分析法、法经济学分析法、比较研究法以及实证分析法,立足于完善我
国补贴与反补贴立法,从分析协定中关于补贴与反补贴的相关规定入手,探讨在国外对
华反补贴的形势下我国补贴与反补贴立法的完善及对策研究。全文由四部分组成:
第一部分,补贴与反补贴概述,首先引入补贴的概念,对补贴进行分类,然后回顾了国
际反补贴法的历史发展与规则演变。
第二部分,从实体规则研究和程序研究两个方面对《协定》进行分析。协定较为
全面和系统地对补贴与反补贴制度做出了规定,充分了解和掌握协定为后文对我国补贴
与反补贴制度的完善研究奠定了理论基础。
第三部分,对美国、欧盟、加拿大三国对华反补贴形势进行分析来说明我国遭遇国际反
补贴的现实可能性和完善反补贴立法的紧迫性。
第四部分,从补贴、反补贴两个方面进行立法完善,并探讨我国面对反补贴挑战的应对
措施。

Abstract
The issue of subsidy includes two aspects, one is subsidy, and the
other is anti-subsidy. Countervailing measures rule regulates the subsidy
and the anti-subsidy. SCM agreement not simply regulates the subsidy
conduct of the government or purely takes countervailing measures. The
agreement of SCM regulates the subsidy and anti-subsidy at the same
time, and stipulates strictly the countervailing measures and its
procedures. Therefore, subsidy law, especially international integrated
anti-subsidy law ,plays an important role in balancing the relationship
between subsidy and anti-subsidy.
With the export increasing and the large trading strong country
establishment in China, the export products in China are facing with
more and more investigations. All the evidence indicates that the
investigations of countervailing measures are raising. So the government
and the enterprises should make full preparations for the anti-subsidy
suits.
The article introduces many methods such as the method of historic
analysis, of law economic analysis , parative study and of
