提要
地方政府是地方经济发展的主要推动者,也是地方事务的主要管理者,而在其
利用和管理土地资源的过程中,不仅没有强化自身的土地管理责任,反而出现了大
量的失范行为。诸如,推动农地过度非农化、操纵土地价格、违规使用土地出让金
等。这些行为直接导致了建设用地的过度扩张,从而引发了多方面的问题。如,耕
地减少、干扰市场效应、失地农民增加、影响社会稳定等。可见,有效解决这些问
题的关键是规范地方政府的行为。本文论述了地方政府土地失范行为的具体表现,
回顾了中央政府规范地方政府失范行为的措施,并从中找出了失范原因分析及问题
解决的两个关键点,即失范动因以及制度途径。最后,提出了有针对性的对策建议。
研究发现,中央政府采取了一系列的措施来规范地方政府行为,短期来看效果
明显,但长期却收效甚微。这表明,仅仅依靠行政手段无法有效规范地方政府的失
范行为。地方政府的“不理性”行为,有其存在的内在动机和制度途径,即地方政
府以实现其利益最大化为行为目标,而土地恰好具备了使其实现目标的特征条件。
因而,地方政府热衷于攫取土地收益而不惜违法违规,失范行为成为了地方政府的
“择优选择”;而现行土地制度安排又赋予了地方政府实现其动机的权力和条件。因
此,笔者认为,一方面需要削弱地方政府行为失范的动机,另一方面必须消除地方
政府行为失范的制度原因,从而切断地方政府行为失范的现实途径,这样才能从根
本上规范地方政府行为。

Abstract
Local governments are both major governer of local affairs and primary drivers of
local economic development. However, local governments were keen to many anomie
behaviors at the process of using and managing land resources, such as promoting
non-agricultural land、manipulating land prices、using land rent illegally and so on. These
behaviors resulted directly in over-expansion of construction land and further resulted
many land problems ,for example, reduction of arable land、interference of market effect、
the social instability because of the increasing number of the peasants who losing land
and so on. So it must to regulate the conduct of the local governments to resolve the land
question. In this paper, it was found out the two key points: the motivation of anomie and
the way of the system after describing the performance of the local governments and
recalling the measures of central governments. It is said that central governments
regulated the local governments’ behaviors by many measures, but the effect was not
