中文提要

在世界经济一体化和国际贸易自由化发展的背景下,使得国家间建立起来了日益
紧密的分工合作体系,全球性的加工日趋多国化。作为确定进出口货物“经济国籍”
的原产地规则,是进口国对货物确定税率待遇、进行贸易统计、实行数量限制和控制
从特定国家进口的主要依据之一,在国际贸易中具有越来越重要的作用,并已成为一
国经济贸易政策的重要组成部分。由于目前世界范围内尚未建立起原产地规则的相互
承认机制,各国均根据各自的经济利益,制定了各自不同的原产地规则。特别是目前
源于美国“次贷危机”引发的全球性的金融危机,美国总统奥巴马签署包含“购买美
国货”条款的巨额经济刺激计划,国际贸易环境很可能会因为贸易保护主义的迅速抬
头而急剧恶化,并导致世界经济面临更加严峻的衰退威胁。近年来,利用产品质量标
准、反倾销等手段构筑贸易壁垒的举动日趋增多,而“购买美国货”条款则赤裸裸
地把贸易保护主义推向台前。

加入后的实践过程中,随着中国对外贸易的迅速发展和规模的不断扩张,面
临的国际贸易环境也越来越复杂,原产地规则在中国对外贸易发展中的作用也越来越
突出,但是由于我国原产地规则的不完善以及贸易发展中存在的问题,限制了原产地
规则作用的进一步发挥。我们有必要了解目前我国原产地规则的不足研究并借鉴欧
盟及美国的原产地规则在遵守规则的前提下对我国的原产地规则加以完善。

Abstract

Under background developing in world economy integration and international trade liberalization,
the feasible country has built gradually rapid and intense sharing out the division and cooperating
with one another system, and global processing of the increasingly multinational. Import and export
goods as a basis for determining "economic citizenship" rules of origin, is that the entrance country
ascertains tax rate pay , trade statistics, quantitative restrictions and controlling main part entering
port from the specially appointed country into practice . It has the more and more important effect,
and already ing one country economy trade policy in international trade. Around the world
because of the current rules of origin have not yet established the mechanism of mutual recognition.
States are in accordance with their respective economic interests, to develop their own different rules
of origin. Originate from the global financial crisis that "time of USA subprime mortgage crisis"
initiates especially at present. American president Obama signs the huge sum economic incentive
