我国农民工工伤保险问题研究

摘要
农民工是具有农村户口而职业上属于工人的劳动者,是经济社会转型时期
的特殊社会群体。
农民工的出现既解决了发达地区劳动力不足的问题,也缓解了不发达地区
大量剩余劳动力的就业压力,成为推动国民经济增长,促进产业结构调整的新
动力。但由于各种条件的限制,农民工多从事建筑业等高风险、职业病多发的
行业,缺乏必要的劳动保护。新的劳动环境、劳动工具与劳动方式,不可避免
地会带来新的劳动风险,加之农民工处于相对弱势的地位,更易发生工伤事故
和职业病。从层出不穷的农民工工伤事故到规模惊人的农民工职业病群体,均
决定了针对农民工的工伤保险制度应当作为我国最基本的社会保障项目尽快得
到确立。
本文认为,农民工工伤保险制度的建立和完善是加快我国城市化和工业化
进程的需要,不仅有利于维护农民工的合法权益,推动“三农”问题的解决,
还有利于社会保障制度改革长期目标的实现。
本文依次从农民工工伤保险制度的时效性、内容、覆盖范围、与其他制度
的兼容性等四个方面阐述了该制度建设和实施过程中的各种矛盾;从观念、国
情、经验和监督等四个方面对矛盾的成因进行了分析,认为一方面部分人对农
民工工伤保险制度存在认识上的误区,另一方面生产力相对落后等客观条件起
了限制作用,经验不足和监督不力也是重要原因。
本文针对上述矛盾和问题提出了改革思路和政策建议,认为农民工工伤保
险制度迫切需要解决的问题包括:覆盖面、待遇水平、支付问题,差别费率,
基金的使用等。

Abstract
Peasant workers refers to the peasants whose occupation is worker, while living in a rural
household. They are a special social group in an economic society undergoing transformation.
They not only solve labor shortage problems in some developed areas, but also alleviate the
surplus labor employment pressure found in many underdeveloped areas. This promotes economic
growth and industrial restructuring.
However, owing to various constraints, the peasant worker’ jobs are often high-risk and have a
high rate of occupational disease. They lack the necessary labor protection afforded other workers.
New labor environments, tools and methods inevitably bring new risks. Peasant workers are forced
to suffer these occupational hazards.
Because of the endless number of injuries from accidents and the huge group of peasant
workers suffering from occupational diseases, an industrial injury insurance system for peasant
workers should be established as one of the most basic social security systems for this group.
