在知识经济时代,知识产权已经日益成为新型的市场竞争手段,并且越来越受到
企业和国家的关注,权利人为争夺资源,利用知识产权自身的专有性和竞争优势特点
滥用知识产权垄断市场,破坏良性的市场竞争环境。因此,研究如何规制知识产权垄
断问题已经成为知识经济时代发展的需要。
为了更好地规范知识产权的行使,防止知识产权垄断行为损害公平、自由、有序
的市场竞争环境,本文将结合知识经济时代的发展,提出在新形势下知识产权垄断的
新特点。始终围绕知识产权垄断展开讨论,以知识产权的私权性即合法垄断权为着眼
点,探讨知识产权滥用、知识产权合法垄断、知识产权滥用导致的垄断三者间的概念,
进而分析知识产权滥用与知识产权垄断之间的关系。并且从我国现有规制知识产权垄
断的法律入手,结合国外关于规制知识产权垄断的相关法律规范和我国相关方面的案
例,提出在当今知识经济时代下,应加强知识产权法和反垄断法的融合。通过讨论现
有法律规范和制度的缺陷和不足,提出应在《反垄断法》框架下而不是知识产权法中
规制知识产权垄断行为的原因、特点及必要性,并且借鉴国内学者理论和国外先进经
验,提出我国在《反垄断法》框架下完善知识产权垄断的措施及对策建议。

Abstract

In the time of knowledge-based economy,intellectual property is getting more
attention and has e an important way pete in the petitors take
advantage of intellectual property’s exclusive to occupy the market and make bad influence.
How to regulation the abuse of intellectual property has ing the real need in morden
economic society.
This thesis will analyze the latest features of intellectual monopoly according to the
development of the knoledge economy to better regulate the exercise of
around intellectual monopoly and intellecyual property’s exclusive,analysising of the
relationship between intellectual monopoly,monopolisitic practices involving property
rights and intellectual property antitrust. After learning the reasonable regulating on the
abuse of Intellectual Property, the author will also learning and summarizing the ess
experiences and legal practices on regulating the abuse of Intellectual Property by the
Antimonopoly Law all over the world and countries, the enlightenment will be given to
perfecting our own legal regulating system on abusing Intellectual Property.
