文档介绍：山东大学硕士学位论文中文摘要旅游业已经成为世界上发展势头最为迅猛的产业,在世界经济中扮演着越来越重要的角色。尤其是20世纪90年代以来,旅游业取得了快速发展,并逐渐成为世界上最大的产业之一。我国的旅游业是在改革开放以后,才取得长足发展的。遗憾的是,与旅游业紧密相关的法律制度仍然相对滞后。尽管我国国务院、国家旅游局、地方人大、地方政府及地方旅游局等部门陆续颁布了一些有关的法规、规章和文件,对旅游业的发展起了一定的作用。但是,旅游法规位阶低、不协调、立法空白多等缺陷严重阻碍了我国旅游业的健康发展。因此,制定一部完整的《旅游法》迫在眉睫。文章从理论探索的角度对我国《旅游法》立法方面的诸多问题进行了研究。具体来说,全文共分引言、正文、结语三部分,其中正文又由三部分组成: 第一部分为旅游法概述。首先论述了旅游法的概念、特征及渊源。其次介绍了世界旅游发达国家及我国的旅游立法状况。最后阐述了我国《旅游法》立法的必要性和可行性。第二部分为《旅游法》的立法模式选择及其基本原则。首先对我国《旅游法》立法模式的选择进行了分析,指出我国应坚持注重国情基础上的与国际社会相接轨的模式。其次论述了我国《旅游法》应遵循的基本原则,包括遵循市场经济规律原则、保护旅游者和旅游经营者合法权益原则、可持续发展原则、与国际接轨原则。第三部分是对我国《旅游法》基本框架的设想和对主要制度的分析、完善。首先指出我国《旅游法》应采取总则、分则、附则式的立法结构。其次论述了我国《旅游法》应规定的基本内容。最后对我国《旅游法》中几种主要制度进行了分析和完善, 包括国家旅游管理制度、旅游主体权益保护制度、旅游资源科学开发制度、旅游业丌放领域准入与经营管理制度等。关键词:旅游法立法模式基本原则主要制度撇:、Ⅷ逸氏若马:口加,一印刚2· 阂硼:-卫I ABSTRACT Tourist industry hasalready e afastdeveloping and prospective new industry in theworld,and plays allimportant roleintheworld the 990s,the tourist industry getsrapid development es one ofthegreatest industries intheworld.
