摘要
个人信息安全保障既是保护个人权利的需要,又是推进信息化建设和推动政务
公开的需要。本文将对个人信息权保护的基础问题进行深入分析。
全文分为引言、正文和结论三部分,正文共分四章:
第一章个人信息权。本章主要包括个人信息权的主体、内容、客体和性质四个
方面的内容。在对个人信息权进行全方位分析研究的同时,也对一系列争议问题进
行了比较分析。这些问题主要包括:个人信息权主体是否包括法人;个人信息权客
体的法律称谓问题;个人信息应当采取何种定义模式;主观信息、错误信息和间接
信息是否构成个人信息;个人信息的性质;个人信息保护法是否适用于手动处理的
个人信息;敏感个人信息和个人信用信息问题;个人信息权与姓名权、名誉权、隐
私权和肖像权的关系等。
第二章个人信息权保护的法律责任。本章首先分析了保护个人信息权的基本立
场和基本原则。以此为基础,对个人信息侵权表现、归责原则和法律责任进行深入
研究,从行政责任、民事责任和刑事责任三个角度全面阐释了个人信息权保护保护
的法律责任。
第三章个人信息权保护的运行机制。所谓法律的运行机制,是指保证法律有效
运行的机制。本章对个人信息保护法的监督机制、执行机制和自律机制进行了分析
和探讨。
第四章健全我国个人信息权制度的思考。结合立法现状,将前文的分析和探讨
加以汇总,并在此基础上系统列出对个人信息保护立法和司法上的几点思考,以期
对我国个人信息权保护有所裨益。

Abstract
The guarantee for individual information is not only the requirement for protecting
personal right but also the need for promoting the construction and driving the policy
open. This article will focus on the basic problems for individual information and
research with argument
The whole article will be divided into introduction, main body, and conclusion 3
parts, and the main body has 4 chapters.
The 1st chapter is Personal Information Rights. This chapter includes four parts: the
right of personal information’s body, content, object and nature. At the meaning time of
analyzing the right of personal information, a series of controversial issues were
analyzed too. These issues include : whether the right of personal information’s body
includes the legal person; the right to object of personal information’s appellation; the
way to define personal information; whether the subjective information, false
information, and indirect information is personal information; the nature of personal
information; whether the Personal Information Protection Act applies to manual
personal information; sensitive personal information and personal credit information
issues; the relation between personal informa
