旅游业作为一个独立的产业,具有发展速度快、投资回报率高、拉动相关产业发展的特点,在我国国民经济发展中占有重要的地位,旅游业已经成为一个新的经济增长点。随着旅游经济的快速发展,旅游已逐渐成为人们新的消费点,旅游消费者权益保护问题也越来越发成为人们所关注的热点。本文根据旅游消费、旅游者权利以及旅游产品的特性,借鉴了旅游立法发达国家的做法,围绕旅游法的出台和旅游消费者权益的保护做了一些理论上探讨,并提出了一些具有可行性的措施。本文第一部分,旅游业消费者权益基本理论概述,主要包括旅游消费、旅游消费者和旅游消费者权益的基本概念及其特征。第二部分,我国旅游业消费者合法权益保护的现状及必要性,主要从我国旅游行业的发展状况和旅游行业的立法方面阐述了我国旅游消费者合法权益保护的现状。同时,从旅游产业角度分析了旅游消费者合法权益保护的必要性。第三部分,我国旅游消费者权益保护现存问题,主要从我国法律环境和国外立法现状角度,以及旅游者受侵犯状况分析了旅游业消费者权益保护的五大问题,即旅游消费者基本权利、格式合同、旅游争议、精神损害赔偿、时间浪费和维权方式存在的问题,为下文对策的提出奠定了理论基础。第四部分,旅游消费者权益保护法律制度构建,这一部分主要从立法角度对旅游消费者合法权益的保护做了理论探讨,并给出了自己的一些建议。

Abstract
Tourism as a separate industry, has the characteristics of high speed, high returns on investments and spuring the development of related industries on, occupy an important position in national economic development. Tourism has e a new economic growth points. With the rapid development of tourism economy, tourism has gradually e a new point of consumption, tourism consumer protection issues are increasingly ing the focus of attention. Basing on consumer rights, tourists and the characteristics of tourist products, drawing on the tourism legislation practice in developed countries, this article has done some theoretical study on the introduction of laws and consumer protection of tourism, and proposed a number of feasible measures. The first section of this article overviews the basic theory of consumers ' rights, including tourism consumption, consumers and the basic conception and characteristics of tourists ' rights. The second part presents the current situation and the necessary of the protection of consumer interests in China, it mainly expounded present status of the protection of tourism consumers, rights in Chain from the tourism industry and the development of tourism industry legislation.
