摘要
在旅游消费活动中,侵害旅游消费者合法权益的事件层出不穷,这已成为我
国旅游业发展的障碍。
侵害旅游消费者合法权益的表现形式多种多样,譬如旅游经营者通过虚假广
告欺骗旅游消费者、旅游经营者之间存在不正当竞争行为、旅游格式合同普遍存
在“霸王条款”现象以及导游人员欺客、宰客、拿回扣等。究其原因,一是旅游
产品的特性导致旅游信息的不对称;二是旅行社的整体规模小、素质差;三是导
游人员薪金制度不合理;四是旅游消费者法律保护意识缺乏。这显示出了我国旅
游消费者合法权益保护存在的立法缺陷,譬如旅游法律体系不健全;旅游合同形
式不完善;旅行社质量保证金数额较低;旅游纠纷缺乏违约精神损害赔偿规定;
旅游纠纷诉讼制度不利于旅游消费者维权。
针对我国旅游消费者合法权益法律保护的缺陷,文章建议在旅游消费者合法
权益法律保护方面进行如下完善:构建比较完备的旅游法律体系;规范旅游合同
的形式;提高旅行社质量保证金的数额;建立旅游违约精神损害赔偿制度;建立
完善的旅游纠纷诉讼制度;强化旅游行政管理部门的监管职能。此外,加强旅游
行业自律也不失为旅游消费者合法权益法律保护的有益补充。

Abstract
Invading tourist’s legitimate right has been occurred all the time in the tourist’s
consuming activities, which has became the barrier of Chinese domestic tourism
industry.
Invading tourist’s legitimated right has shown in various ways, such as tour
operators cheat tourists through mercials; the existing unfair
competitions among tour operators; unfairly taking tourist’s advantages via unfair
contracts clauses; or tour guide cheats, overcharges and missioned tourist.
These defaulted behaviors are resulted from reasons as follow: first of all, the
characteristics of tourism products cause the unevenly distributed tourism information;
secondly, the general quality of the industry can not reach what it should be and the
size of the industry does not reach its full potentials too; thirdly, the salary system is
irrational; finally, tourists do not know how to protect themselves by using law. All
these illustrate there are legitimate flaws in Chinese tourist’s legitimate right
protection, such as the unsound tourism legal system; pleted form of tourism
contracts; insufficient amounts of deposit for service quality guarantee; lack of mental
pensation system for breach of contract in the tour contract; unfriendly
tourism disputing and litigating system to tourist’s legitimate right .
