文档介绍:中文摘要中文摘要劳动权是公民基本权利之一,同其它基本权利一样需要法律制度的保护。一个国家劳动争议处理制度,是该国劳动立法完善与否的重要标志。我国劳动争议仲裁制度自80年代恢复以来,其发展已有近30的历史。我国劳动争议处理制度自建国以来一直延续着“一调一裁两审”的模式。不可否认,该制度模式在调整劳动关系、维护劳动者和用人单位合法权益、促进劳动关系和谐稳定方面发挥重要作用,但随着我国市场经济体制改革的深化和社会主义市场经济制度的逐步完善和发展,我国劳动关系也发生了深刻变化。劳动争议也呈现出了许多新问题、新情况和新特点。2008年1月1日颁布实施的《劳动争议调解仲裁法》虽在实体问题和程序问题方面均做了相当大的调整,但依旧暴露出立法设计上的不足和缺陷。劳动争议仲裁制度改革呼声也日益高涨。本文旨在从实务的角度浅谈劳动争议仲裁制度存在的问题,并提出了一些解决方法。以此期待为将来劳动争议仲裁制度立法的改革提供参考。关键词:劳动争议;劳动争议仲裁制度;法律研究黑龙江大学硕士学位论文 Abstract Right towork is one ofthefundamental rights ofcitizens,he andotherbasic constitutionalrights,like theneedtoprotect nationallabordispute, laborlegislation ofthecountry all important 's labor dispute arbitrationsystem recover from80years sinceitsdevelopment nearly 30history.
