文档介绍：劳动教养制度缺陷与改革研究摘要建国初期,在政治斗争形势异常严峻,新中国阶级统治工具还不完善的情况下,以及为处置一些不够刑事处罚的反革命分子、坏分子,使他们有出路,有工做,实现他们的就业问题,中共中央出台了相关的政策创建了极具中国特色的劳动教养制度。劳动教养创建之初,在保卫新生的国家政权,维护政治稳定,维持社会治安秩序,预防、减少和控制犯罪等方面,发挥了重要的作用,也作出了重大的贡献。随着社会经济的发展,改革开放以来特别是依法治国方略的提出与实施,劳动教养制度已经越来越不适应当前社会的政治、经济、法律、公共管理、人权保障的要求。改革、废除劳动教养制度的呼吁越来越激烈,成为理论界、学术界研究的热门话题和难点问题。从表面现象进行分析,劳动教养制度的缺陷主要在于其理论基础、法律规范、执行体制机制等方面,造成既不合法,又侵犯人权的现状。而从实质上研究劳动教养制度的缺陷,牵系到司法、行政等职能部门的部门利益和权力的配置不均衡, 牵系到公权力与私权利不对等的问题,劳动教养制度改革与司法体制改革、行政体制改革密切相关。本文将采用文献研究方法、比较研究方法、调查研究方法等,综合运用政治学、法学、公共管理学、经济学等多学科的知识,主要以公共管理学为主,分析和思考了劳动教养制度改革的研究现状与研究背景,同时比较研究了国外与劳动教养相关的制度,全面审视了劳动教养制度的理论基础及各个历史阶段的作用, 分析和思考了劳动教养制度存在的缺陷及其原因,在此基础上提出了自己关于劳动教养制度改革的设想。关键词:劳动教养;缺陷:改革 H Ab stract Intheearly years ofnew nation,under the circumstance ofextremly stem p01itical situation andimperfection ofnew Chinese social class rules ordertohandle some counter-revolutionary and badwho are insufficient forcrlmlnal punishment,to solve theirproblem ofemployment andmake them have labor to do and outlet,the mittee of P appears the relatedpolicy tofound the education- system withChinese characteristics extremlY· At thebeginning oftheeducation—through·labor foundation,it had played the vital r01e andmade a significant contribution indefending newborn state Power' maintaining political stability and social order by prevent,decease,control crlme· However,since along with development of socialeconomy and imPlementatlon of mning ording tolaw,the education。through-labor sYstem does not adapt the current soeiety’s request ofpolitics,economy,law,public management’ human rights safeguard.
