文档介绍：秘密侦查措施法治化研究中文摘要秘密侦查措施法治化研究中文摘要在当今刑事犯罪越来越呈现组织化、科技化的趋势下,常规的、公开的刑事侦查措施面临前所未有的挑战。现代犯罪带来的压力,使我国刑事侦查机关越来越倾向于主动出击打击犯罪。这一趋势使得在打击和预防犯罪方面有特殊效果的秘密侦查措施得以认可,在侦查实务中被广泛的运用。在肯定秘密侦查措施在实践中发挥巨大作用的同时,由于秘密侦查措施具有秘密性、易侵权性的特点,实践中常常给公民的合法人身权利尤其是个体的隐私权带来严重的侵害。相对于西方法治国家均立法严格对相关的秘密侦查措施实施控制而言,我国对秘密侦查措施的实施未有明确的法律规定。因此,如何构建我国秘密侦查措施法治化的模式成为刑事诉讼法学界研究的热点。国内相关的理论研究主要针对秘密侦查措施中的监听侦查、诱惑侦查等个别侦查措施上,对于国外相关法律制度的描述未能从司法制度的整体设制以及变革中进行考察。本文在对主要法治国家的秘密侦查措施进行比较研究后,归纳总结法治国家对于秘密侦查措施立法的价值取向及原则,结合我国刑事侦查的实际情况,探索我国秘密侦查措施法治化的途径。关键词:秘密侦查价值分析比较研究制度构建作者:戴晓峰指导老师:刘文 Research the Rule ofLaw Secret Investigation Measures Abstract Research on theRule ofLaw in Secret Investigation Measures Abstract With the trend ofmore anized crime andhi-techcrime,conventional and open criminal investigation measures are facing unprecedented the pressure ofmodem crime,thegrowing tend ans are prone bat trendmakes secret investigation,which hasspecial effectsinthefightagainst andtheprevention ofcrime,extensively used ininvestigation the salne time,the secret investigative measures often hurtthe citizen‘Slegal rights,especially thepersonal privacy oftheindividualseriously because ofits ease of pared wim the strictlegislation of theimplementation of secret investigation inWestern countries,we don’t have explicit legal regulation on the implementation ,how tobuild China's model ofregulation on secret investigative measures e ahotacademic theoretical researches arefocused on theindividual measures like secret eavesdropping and descriptions ofrelevantforeign legalsystem are not based on the research ofthe whole system design paper studies the secret investigation measures ofdeveloped paratively,sums up relevant legislation valuesandprinciples,and explores theapproaches oftheregulation of secret investigation measure in our bining actualsituation.
