行政合同之我见

内容提要: 中国法不宜沿袭法国法上的行政合同制度及其理论,因为按照中国法的通说,它关于确定行政合同的标准,在中国法上均存在着问题;它认为属于行政合同的类型,在中国法多属于民商合同的范畴。
法国的行政合同制度及其理论特别发达,我国有的学者自觉不自觉地予以接受,并试图以之为标准区分中国法上的行政合同与民商合同,以之为模式构建中国的行政合同制度及其理论。对此,笔者持有不同意见,在方法论上,应当首先须明确行政合同的概念与判断标准,其次须将所谓行政合同类型化,然后对各个特定类型加以定位。
