文档介绍:A study on road property protection in the highway administration A Dissertation Submitted for the Degree of Master Candidate : Li Min Supervisor : Prof. He Hongbin Chang ’ an University, Xi’ an, China I 摘要路产保护是公路路政管理的重要任务之一,也是路政管理学关注的热点问题。路产保护水平的高低直接关系着我国公路交通能否持续、健康、快速地发展。我国的公路路产保护工作虽取得明显成效,但深层次的问题尚未根本解决。特别是地震、泥石流、雨雪冰冻灾害等公路突发事件的发生,对公路路产保护工作提出了更高的要求。如何提高路产保护水平,更好地应对不断出现的新问题,也成为公路路政管理面临的重要任务。本文基于以上的理论和现实需要,运用行政管理学、管理学、行政法学、制度经济学等知识,以公共产品理论、组织结构理论、依法行政理论、公共服务理论、制度变迁理论作为理论基础,针对我国公路路产保护中存在的问题,结合发达国家公路路产保护经验,从法律法规、机构设置、职权划分、保护手段、执法人员、经费保障等方面提出了相应的对策建议。旨在丰富公路路产保护的相关理论,探索路产保护制度的创新之路, 规范路产保护的行政执法,以更好地发挥公路路产在国民经济发展中的作用。本文采用文献分析法、比较分析法等对我国公路路政管理中的路产保护进行了深入研究,并得出几点结论:政府主导是提高公路路产保护水平的关键要素;制度创新是提高公路路产保护水平的重要途径;服务公众是提高公路路产保护水平的根本目的。关键词:行政管理、公路、路政管理、公路路产、路产保护 II Abstract Road property protection isone of the central tasks of road administration and it is an important issue of road administration research, the level of road property protection is directly related to the sustained, healthy and rapid development of transport. Road property protection inour country achieved remarkable results, but deep-seated problems have not been revolved. In particular, the occurrence of highway emergencies puts forward higher requirements for road property protection. How to improve the level of protection of road property to better respond to the new issues is important task of road administration. This article is based on the theoretical and practical needs, using the knowledge of administrative management, management, administrative law and institutional economics to analysis related issues. And it ison the basis of public goods theory, Organizational structure theory, the theory of administration by law, public service theory and institutional change theory. This article points out the problems in the system of road property protection and puts forward some countermeasures on the basis of learning from the experience of road property protection in developed countries.
