一、问题的提出
家暴是家庭暴力的简称，国际通用词为“Domestic Violence〞，简称DV。自家庭组建以来，家庭暴力就一直相伴而生。近些年，家庭暴力越来越受到社会的普遍关注，这不仅因为它是法律关注的一个现象，更是一个十分突出的社会问题，家暴极大地威胁着妇女儿童的身心健康、家庭的稳定以及社会的有序运行。一般意义上，家庭暴力是指发生在家庭成员之间的，以殴打、捆绑、禁闭、残害或者其它手段对家庭成员在身体、精神、性等方面进行伤害和摧残的行为。在我国，婚姻法中所称的家庭暴力指的是“行为人以殴打、捆绑、残害、强行限制人身自由或其他手段，给家庭成员的身体、精神等方面造成一定伤害后果的行为〞。［1］ 据全国妇联调查， 亿个中国家庭中，30%不同程度存在家庭暴力；每年约40 万个解体的家庭中，1/4 缘于家庭暴力。［2］在社会急剧转型的今天，人们的生活节奏普遍加快，生活压力迅速上升，诸多因素共同作用使得家庭成员的社会角色扮演愈加复杂，社会角色更加紧张。现代社会的快速变迁直接影响着家庭暴力事件的逐年上升，反家暴也就成了一项长期而艰巨的斗争。
