小产权房的政府规制对策研究
摘要
小产权房是指在农民集体土地上,由乡镇政府或村委会单独或联合
开发商开发建设并向本集体经济组织外成员销售的房屋。小产权房之所
以为“小”的根本原因在于房屋所占土地性质的特殊性导致房屋产权的
有限制性。由于集体所有土地的所有权在法律的种种限制下无法充分行
使,致使集体土地上建造的房屋除了占有使用权外无法完整的实现各项
权能。小产权房具有权利不完整性、涉及利益主体多元性、价格低廉性。
小产权房的产生具有多种原因,其中土地二元制度等制度性成因起了主
导作用,同时,关于集体土地和其上房屋的相关法律规范的缺失或矛盾
也是造成小产权房产生的因素,此外农户、城镇居民、房产(建筑商)、
村镇(乡)政府等主体的利益驱动和政府管理的缺陷都是小产权房的成
因。小产权房的存在反映了制度、管理缺陷,城乡差别待遇政策中农民
对政策制度的警醒和抗议,它的存在和大量扩展揭示了制度创新的迫切
需要,是合理调整城乡利益分配、促使两种土地所有制度向公平合理化
方向改进的催化剂,同时在我国现有法律规范下小产权房的存在也深刻
地影响着当前我国房地产市场体系和城市化发展,给购房人带来利益风
险。在借鉴我国各地对小产权房规制和相关体制改革的基础上,本文提
出要按照平等、维稳、循序渐进、可持续发展的原则规制现有小产权房,
同时着力改革我国城乡土地二元体制,建立集体土地使用权流转制度,
统筹城乡房地产发展。

RESEARCH ON THE COUNTERMEASURES OF
GOVERNMENT REGULATION ABOUT SMALL
PROPERTY RIGHT HOUSES
ABSTRACT
Small property right houses (plete property rights) is referring to
the houses built by the township government or mittee alone, or
jointly developed with a property developer, on the farmer’s collective land,
and then sold to the members outside of the collective anizations.
The fundamental reason for the small property right being "small" is the
nature of the specific land property rights that the houses have built on, have
resulted in restrictive housing property rights. As a result of the collective
ownership land rights can’t be fully exercised under the restrictions of law,
consequentially, the houses constructed on such lands possess any other rights
apart from right of occupancy and usage, they do not hold other rights
completely. Small property right houses are prehensive on rights,
diversity of interests related to many parties, low property rights
houses arise with a variety of reasons, amongst which the dual land system
