摘要:依法行政是我国法制建设的重要内容,是依法治国原则在行政领域的具体运用。由于《行政许可法》颁布时间较迟且具相对稳定性,而经常项目法规涉及面广并且其交易行为和管理目标具有多变性特征,因此,两者在细节上难免存在不吻合之处,导致实践中的具体操作发生细节上的偏差。本文总结了经常项目依法行政实践中存在的问题,相应提出加快经常项目依法行政建设进程的思路。

经常项目外汇管理是外汇行政管理的重要组成部分,必须遵循国家法律法规,有效推进依法行政进程。本文拟从经常项目外汇管理的立法和依法行政的现状入手,分析依法行政存在的问题,提出推进依法行政进程的建议。
