随着我国城市化的快速发展,对农村集体土地征用的规模也日益扩大,土地征用不仅关系到农民集体的切身利益,也深切关系到整个社会经济的稳定和健康发展。因此,如何处理好土地征用过程中国家公共和农民集体的利益问题,已成为这项工作的重中之重。目前,我国土地征用相关的法律法规尚不够完善,工作过程中也常常存在一些偏差,因此而导致的农民补偿标准偏低、安置欠妥等问题,影响了土地征用工作的健康进行。针对这些问题,政府必须完善相关法律法规、改进工作方式、给予被征地农民合理的补偿及妥善的安置,以达到城市化快速健康发展的目的。

Abstract
With the rapid development of urbanization in China, The rural collective land acquisition of rural are also increasing in size. Land acquisition not only to the immediate interests of the collective farmers. It also deeply related to the socio-economic stability and healthy development. So, how to handle the national public land acquisition process and the collective interests of farmers, has e a top priority of this work. In the current, China's laws and regulations related to land acquisition is still not perfect, course of their work and often there are some deviations, the consequent low standard pensation of farmers, placement defects and other issues, There are affect the health of the work of land acquisition. To solve these problems, government must improve the relevant laws and regulations, improved working methods, given to landless farmers pensation and proper resettlement, to achieve rapid and healthy development of urbanization, the purpose of.

一、引言
近年来,随着我国各地城市化进程的不断加快,对建设用地的需求也进一步提高,有不少农村集体的土地在公共利益需要的前提下,被征为国有以满足城市化进程中居住、商业及工业使用的需要,并且其土地征用的规模也在不断扩大。按现行我国法律的规定,农村土地征用是发生在国家与农村集体之间所有权的转移,具体地说,是依据法律规定的程序和批准权限批准,在依法给予农村集体经济组织及农民补偿后,将农民集体所有土地使用权收归国有的行政行为。由于农村土地征用涉及国家,利益团体以及被拆迁人的切身利益,如何协调好各上述各方面的利益,已成为一个重中之重的问题。
