中文摘要
鉴于当前我国市场中各种制售伪劣产品犯罪的态势日趋严重,重视对生产、销售
伪劣产品罪的理论研究十分必要。从现行刑法分则 140 条以及相关司法解释的规定来
看,伪劣产品的销售金额在生产、销售伪劣产品犯罪中有着重要作用,是影响此类犯
罪定罪量刑的关键因素之一。因此,准确理解销售金额、认真研究其刑法意义,对于
生产、销售伪劣产品这一类犯罪的认定与处罚具有重要的现实意义。本文从《刑法》
第 140 条的“销售金额”的来源展开论述,讨论了其立法目的与实质内涵,并结合司
法解释中提出的“货值金额”以及对本罪未遂形态的认定,阐释了关于“销售金额”
一些理论矛盾。最后,结合对选择性罪名的一些基本问题的分析,本文提出,应该在
立法上重构生产、销售伪劣产品罪,使得有关此类犯罪的数额问题有一个更清晰、明
确的认定标准,以消除司法实践中的分歧。

The Studying of Sales Amount
——Another Interpretation on The Crimminal Charge of
“Producing and Selling Fake or Substandard Products”
Abstract
In view of that currently in the Chinese market, the crime situation of producing
and selling fake or substandard products is ing worse and worse, it’s significant to
research the theory of this crimminal charge. In terms of the regulations in current
Crimminal Code and the related Judicial Interpretation, the sales amount of the fake or
substandard products plays an important role in this crimminal charge, being one of the
keys to recognize the chage as well as sentence. Therefore, having an accurate
understanding of the “Sales Amount” and carefully researching its significance in
Crimminal Law, is of great importance. This paper begins on analyzing the origin of the
“Sles Amount” in Crimminal Code, and discusses its legislative intent as well as its
substancial contents. What’s more, this paper also studies the “Value of the Products” in
the Judicial Interpretation and the plished Form of this crime. At last, this paper
explains the existing conflicts in some theories by analyzing certain basic points of
“Selective Charges” regulated in Crimminal Code, and then proposes to modify the
legislation about the “Sales Amount” in order to make the standard of crime
