摘要

教育事业的发展,首先需要的就是经费。合理、高效的高等教育财政投入
制度是我国公立高等教育事业健康发展的基础。自 20 世纪 90 年代至今,我国
的高等教育经历了跨越式的发展,与此相适应,中央在高等教育财政制度方面
也进行了诸多改革与探索。尤其是改革开放以来,我国各级政府逐步加大了包
括公立高等教育在内的高等教育的财政投入,这对于推进我国公立高等教育事
业的发展起到了十分重要的作用。但需指出的是,与世界上高等教育比较发达
的国家相比,我国对包括公立高等教育在内的高等教育财政投入仍然存在诸多
问题,如财政投入总量不足,财政投入不均衡,中央与地方政府的财政转移支
付不到位,教育财政投入立法滞后等问题。鉴此,从财政法的视野对公立高等
教育投入法律制度进行研究,对于构建完善的公立高等教育财政投入法律制度,
促进公立高等教育事业的健康发展无疑具有十分重要的意义。公立高等教育作
为公共产品,对公立高等教育的财政投入是政府应当承担的责任。
本文从三个方面对我国公立高等教育财政投入法律制度展开论述。第一部
分介绍国外公立高等教育财政投入法律制度及其对我国的启示,通过对美国、
英国、日本三国公立高等教育财政投入制度的比较分析,总结出国外高等教育
财政投入法律制度对我国的几点启示。第二部分分析了我国公立高等教育财政
投入法律制度的现状及其存在的问题,尽管我国高等教育财政投入制度建设取
得了一系列的成就,但是还是面临着严重的问题,这些问题主要表现在:公立
高等教育财政投入总量不足;公立高等教育财政拨款方式不合理;高等教育财
政投入地区发展不平衡;高等教育财政财权与事权相分离;公立高等教育财政
投入法律监督制度不完善。第三部分提出了完善我国公立高等教育财政投入法
律制度的建议,主要包括:加大对公立高等教育财政投入的力度,完善多渠道
筹措公立高等教育经费的财政体制;改革公立高等教育的财政拨款方式;完善
公立高等教育财政转移支付制度;健全公立高等教育财政投入的预算管理体制;
建立有效的公立高等教育财政投入法律监督机制。

Abstract

The primary need of education is funds. A reasonable and efficient financial
investment system on higher education is the foundation of the healthy development
of public higher education in our country. Since 1990s, our higher education has
developed by leaps and bounds. Meanwhile, the central government has made lots of
reformation and exploration on financial system in higher education. Especially from
the reform and opening up, the governments from the local to the central have
gradually intensified efforts on financial investment in public higher education, which
plays an important role in the development of public higher education, but we should
point out paring with countries which are more developed in higher
education, there are still some problems in financial investment in our higher
education, including public higher education, such as the lack of total financial
investment, imbalanced financial investment, with the cen
