论我国排污权交易法律制度构建

摘要
随着全球环境的日益恶化,对于如何建立一种行之有效的环境经济制度,各国
均进行了不同程度的改革及试点。作为污染总量控制的重要手段,排污权交易也在
全球范围内推行开来。在我国,排污权交易作为一种舶来品,如果直接适用并不能
解决我国存在的环境问题。反之,更有可能使其变本加厉,加剧我国的污染现状。
因此,我们既要学习国外先进的制度建设,同时也要在我们的国情下进行创新,创
造适合我们自己的环境保护制度,更好地为我们自身服务。
本文在论述排污权交易的概念、优越性和基础性条件之后,借鉴国外排污权交
易制度的启示,重点论述我国排污权交易制度构建的概况。全文分为三章:
第一章排污权交易制度概述,简述了排污权和排污权交易的概念与理论由来,
对排污权交易制度的优越性进行了阐述,并且在介绍国外概况的基础上总结了对我
国的有益启示。
第二章我国构建排污权交易制度的基础性条件,从可行性和必要性方面进行分
析,论述我国构建排污权交易制度的必要性和可利用的条件。
第三章我国排污权交易制度的构建,对我国排污权交易制度从立法原则、主体
客体与形式、交易程序、具体管理制度、政府监管与法律责任,以及配套制度等方
面,进行了构建的设想。

Abstract
With the deterioration of the global environment, every countries make reforms and
experiments in warious degree to build an effectual economic an important
method of pollutant total emission control, emission trading has carry out in the the whole
country. Emission control can't solve nowadays environmental problem if it applied
directly as a exotic. On the other hand,it will worsen the pollution status of our country.
For that reason,we should not only learn the overseas advanced experiences,but also
produce a environmental protection system which answer our needs well and serve
ourselves better.
After the exposition of the idea, advantages ang the basic conditions of emission
trading,this article lay heavy stress on the general situation of make up the Emission
trading system. Paper is divided into three chapters.
The first chapter is a brief introduction of the Emission trading system,.It the idea and
theoretical principle of the right and the emission trading,it also describes the advantages
of the Emission trading system and give a summary.
of useful revelation to our country based on the introduction of the foreign general
situation.
The second chapter is the analysis of the infrastructures of establishing the Emission
trading system in our country,
