摘要
消费者与经营者为相互依存又相互对立的不同营垒,而消费者
作为弱势群体,时常面临因经营者的欺诈、蒙骗、疏忽大意以及恶
意行为所造成的巨大风险和损害。为此,消费者权益保护运动的兴
起,便成为当今世界发达国家乃至发展中国家的共同现象。和谐消
费环境是和谐社会的重要组成部分,是社会各方面消费关系得以有
效协调的综合体现,营造和谐消费环境应当成为消费者权益行政保
护的必然目标,同时,消费者权益行政保护也是营造和谐消费环境
建设不可或缺的保障。本文的任务,就是要研究消费者权益行政保
护的各种特征,以指导和推进行政机关的消费维权工作。本文采用
历史方法、比较研究和实证分析相结合的方法,利用经济法学、民
法学、行政法学的理论,在已有分析研究的基础上,借鉴和吸收发
达国家消费者权益行政保护制度的经验,针对中国消费者权益行政
保护的现状和特点,总结出完善中国消费者权益行政保护制度的三
个基本原则,并在此基础上提出一系列相应的建议。

Study on administrative protection of consumer right
ABSTRACT
Consumers and service-providers are two interdependent groups,
sometimes with conflict of interest, though. Being the disadvantageous
party, consumers often run the risk of being neglected, mislead or cheated.
Consequently, protection of consumer right has e a heated topic in
industrialized countries and developing countries alike. The well-being of
the business environment is crucial to the building of a harmonious
society. The creation of such a harmonious relationship between the
consumers and the corporate world is the central task in administrative
protection of consumer right, which in turn, serves as a guarantee for a
harmonious business environment. This paper deals with the features of
administrative protection of consumer right to facilitate work in this area.
Integrating historic, comparative and empirical approaches based on
economic theories 、civil law and administrative law, the author analyses
the practice in industrialized countries in administrative protection of
consumer right and summarizes three basic principles featuring situation
and characteristics of China. A list of suggestions were put forward in the
paper.

绪论
党的十六届三中全会提出了建立完善的社会主义市场经济体制的方略。市
场经济是法治经济,是有序的自由竞争经济。在世界经济融合程度越来越深的
今天,完善市场经济体制还意味着我国将在更大范围更深程度上参与国际经济
合作和竞争,我国经济将更全面的融入世界经济统
