文档介绍：内容提要本论文采用比较分析、实证分析的法学研究方法,对非法行医罪的有关方面进行了较为详细的阐述和界定。笔者通过比较分析方法,从非法行医罪所侵犯的客体的本质出发,认为非法行医罪的客体为复杂客体,即其侵犯的是公共卫生和国家的医疗管理秩序。其中公共卫生为主要客体,国家的医疗管理秩序为次要客体。非法行医罪的客观行为所指向的是行医行为,是指行为人以医疗行为为职业****惯或者职业倾向的活动。非法行医罪中主体问题是理论界和实务界争议比较大的问题,对非法行医罪主体认定关键就是正确理解“医生执业资格”。笔者通过目前理论界界对如何理解“医生执业资格”的三种主要观点进行分析比较后,认为应对取得“医生执业资格”进行实质解释,即只要合法取得“执业医师资格”的人员就属于取得“医生执业资格”,从而将非法行医罪的主体限定为既没有医学专业知识又没有取得“医师执业资格”的人员。本文对司法实践中关于非法行医罪的基本定量因素即情节严重问题和加重定量因素即结果加重问题中存在争议的方面作了探讨。同时对非法行医罪的共犯中结果加重犯是否存在共犯问题以及从犯罪构成角度对容易与非法行医罪混淆的医疗事故罪、非法进行节育手术罪、故意***(伤害)罪、过失致人死亡(重伤)罪、诈骗罪作了分析比较,阐明了非法行医罪与上述罪名的区别。最后对非法行医罪中可能导致非法行医罪构成的阻却事由中的被害人承诺和期待可能性问题作了阐述。笔者认为被害人承诺不能构成阻却非法行医罪成立的理由。同时认为期待可能性的存否却对非法行医罪的成立具有一定意义a 【关键词】:非法行医司法认定医师资格阻却事由 Absract TheCrime ofIllegal Medical Practice was annewly added charge intheamendment of our Criminal 336 regulates:Whoever illegallyengages inmedical practice without obtaining thequalification formedical practice,and when thecircumstances are serious,shall be sentenced tonotmore thanthreeyears offixed-term imprisonment,criminal detention,orcontrol, and may inaddition or exclusively besentenced to causes serious harm tothe health ofpatients shall besentenced to notless than threeyears and notmore than 10 years of fixed-termimprisonment,and causes thedeathofpatients shallbesentenced to notlessthan 10years offixed-term imprisonment and a Theobjective offended by theCrime ofIllegal Medical Practiceinclude theorderforthe statecontrol on thequalification ofmedical practicing.∞well aspublic charged behaviorsmeen thoseactivitieswith anintentto be aprofessional custom orprofessional trendby SO—calledMedicalPracticing QuaUty should beexplained basic construction ofthecharge isintention,but negligence isthebasic toreach aIlaggravated result.
