摘要

边控(即国家对出入国边境人员的管理控制)工作是当前出入境
边防检查机关的重点工作,习惯上,边检机关长期将所有边控信息(即
国家对出入国边境人员的管控信息)等同国家秘密处理,新中国成立
至今从为确保边控信息秘密不外泄,出入境边防检查机关和相关国家
安全部门耗费了大量的人力、物力。在政府行政逐步公开透明的大背
景下,电子口岸建设中的信息公开最大化成为各口岸管理职能部门的
方向,出入境边防检查机关的边控信息是政府口岸管理信息的重要组
成部分,笔者认为:对于边控信息的性质如何、能否公开很有必要在
学术上进行探讨。本文通过电子口岸建设概念入手,提出了边检机关
信息公开最大化的建设方向,进而将边控信息按照布控类别重新分成
三类:民事案由布控信息、刑事案由布控信息、国家安全事由布控信
息,并按新的分类内容结合国家秘密、工作秘密的有关定义和法律条
款进行比对研究,分析了国家秘密、工作秘密和边控信息的界限,提
出了以公民应享有的信息知情权和出入境权为基础的部分边控信息公
开的大胆设想。

INSPECTION OFFICES IN E-PORT CONSTRUCTION
---TAKING SHANGHAI PORT AS AN EXAMPLE

ABSTRACT

Border control is the key work of exit-entry Frontier Inspection
Offices. All the border control information has been considered has state
secret for a long time. Since the founding of the new China, the exit-entry
Frontier Inspection Offices and related State ans have spent
great efforts to prevent the divulgement of border control information
secrets. In the background of gradual transparency of governmental
administration, all the port functional departments keep moving in the
direction of utmost disclosure of information in the E-port construction,
therein the border control information of exit-entry Frontier Inspection
Offices forms an integral part of the governmental port information
management. Therefore, the author considers there is a necessity to discuss
the nature and feasibility of publicity of border control information by an
academic research. This article starts with the construction of E-port and
put forward the orientation of utmost information publicity of Frontier
Inspection Offices. Then the border control information is reclassified into
the civil, criminal and national public security related cat
