摘要
2006年10月通过的《中共中央关于构建社会主义和谐社会若干重大问题的决定》
将“发展和谐劳动关系”作为构建和谐社会的一项重要任务。和谐的劳动关系是企业
持续发展的前提,是构建和谐社会的基石。和谐社会需要各种社会关系的协调与稳定,
劳动关系是最基本的社会关系,劳动关系协调与否直接关系到社会主义和谐社会的构
建。劳动关系是市场经济体制的基础性关系,牵一发而动全身,并对中国的经济增长、
社会发展和市场经济体制走向等问题发生重要的影响。
改革开放以来,在市场经济条件下,我国私营企业迅速发展,在经济中发挥越来
越大的作用,已成为拉动我国经济增长的重要力量。私营企业劳动关系也越来越受到
企业和社会的重视。然而,随着私营企业的发展,私营企业劳动关系中存在的问题和
矛盾也日益显现出来,成为了制约构建和谐社会的重要因素。
在现代社会,政府的行为已经渗透到经济、社会和政治生活的各个方面。在劳动
关系中管理方、雇主以及工会和雇员的定义相对来说比较模糊,但是政府作为劳动关
系中的第三方,在劳动关系中发挥重要而特殊的作用。在我国目前市场经济体制发育
不成熟的情况下,优化私营企业的劳动关系,政府作为劳动关系的第三方主体,它所
扮演的角色不容忽视。
然而,随着私营企业的不断壮大,私营企业劳动关系中存在的问题和矛盾也日益
显现出来。同时,在私营企业和谐劳动关系构建过程中,政府角色出现了越位、错位
和缺位。面对在私营企业中政府表现出的角色越位、错位和缺位,重新定位政府在私
营企业劳动关系领域中的角色是势在必行。
本文通过对西方劳动关系理论和政府职能理论的横向、纵向分析,结合我国私营
企业劳动关系现状及对政府在劳动关系领域扮演的角色进行分析,在理论上得出重新
定位政府在私营企业劳动关系领域角色势在必行的结论,并对重新定位后的政府角色
进行了分析;在对策上,本研究明确提出了构建政府主导下的和谐劳动关系及其具体
措施。

Abstract
In October, 2006, “to develop the harmonious work relations” is taken as an important
task to construct the harmonious society. The harmonious work relations are the premise of
the enterprise‘s development, and the basement of the harmonious society. Harmonious
society need the coordinate and the stability of every social relations, the work relations are
the most basic social relations, the work relations coordinated or not is the direct effect of
socialism harmonious society. The work relations are the foundation of the market
economy system; they have an important influence to China's economic growth, the social
development and the market economy system.
Since the reform and open policy, under the market economy condition, the Private
enterprise rapidly expanded, has played more and more important role in the economy, and
has e the important force to draw the growth of economic. The labor relations of
private enterprise also receive more and more the enterprise and society’s attention.
