电信业垄断是近年来的热点话题,一方面由于电信业具有公共服务的性质,
国家要对其进行管制;另一方面,随着电信业自然垄断属性的弱化,又需要引入
市场竞争。因此,如果对电信业的管制与市场竞争的关系处理不妥就会产生冲突。
本文以政府管制与反垄断立法为主线,首先对电信业的自然垄断属性和政府管制
进行了论述。然后从经济学的角度分析了反垄断法适用电信业的依据并例证了美
英国家引入反垄断法对电信业发展是有利的。研究了我国电信业改革的历程,并
分析了改革过程中的成败之处,主要探讨了电信改革方案中的政府主导问题。随
后从法律体系,市场机构和垄断行为方面揭示出我国电信业发展现状中的不足。
最后在分析前章的基础上,从反垄断立法、完善政府管制、建立政府管制机构与
反垄断法执行机构的协调机制三方面提出参考性的建议。

Abstract
Monopoly of the munications industry is a hot topic in recent years, while
the munications industry with a public service nature of the country to its
control; if the munications industry, the relationship between regulation and
petition were not handled properly will have a conflict. In this paper, the
government controls the main line with the anti-monopoly legislation, the first of the
munications industry, property and government regulation of natural
monopolies are discussed. And then from an economic point of view of the antitrust
laws apply based on the munications industry and an example of the United
States and Britain introduced national anti-monopoly law on and analyzes the ess of
the reform process of the Department, which focused on the munications reform
program in the government-led issues. Then from the legal system, market institutions
and monopolistic behavior reveals the status of China's munications industry in
